1. Acceptance of these Terms
These Terms of Service ("Terms") form a binding agreement between you and Vice ("Vice", "we", "us", or "our") governing your access to and use of usevice.com, the Vice mobile application, and all related features, content, and services (collectively, the "Services"). By creating an account, joining the waitlist, downloading the app, or otherwise using the Services, you accept these Terms and our Privacy Policy.
If you do not agree, do not use the Services. If you are accepting on behalf of an entity, you represent that you have authority to bind that entity.
2. Eligibility and accounts
You must be at least 18 years old, a resident of a jurisdiction we serve, and legally capable of entering into a contract to use financial features. Waitlist signup requires you to be at least 13 (or the minimum age in your country).
You agree to provide accurate, current, and complete information, to keep it updated, and to safeguard your credentials and device. You are responsible for all activity under your account. Notify us immediately at support@usevice.com if you suspect unauthorized access. We may refuse, suspend, or close an account at our discretion, including for suspected fraud, sanctions exposure, or violation of these Terms.
3. Vice is not a bank, broker, or adviser
Vice is a technology company, not a bank, credit union, broker-dealer, investment adviser, tax adviser, or financial planner. We do not hold your funds. Any deposit, custody, brokerage, or payment services offered through the Services are provided by regulated third-party partners, and your use of those services is governed by separate agreements with those partners, which you must accept before the service begins.
Where FDIC or SIPC coverage is referenced, it is provided by the partner institution under that institution's terms, applies only to eligible balances held at that institution, and does not protect against market loss. Vice itself is not FDIC insured.
Nothing in the Services is investment, legal, tax, or financial advice, or a recommendation to buy or sell any security. Projections, calculators, and growth estimates are illustrative models based on assumptions you or we select, are not guarantees, and do not predict actual results. Investing involves risk, including loss of principal. Past performance does not indicate future results.
4. How the Services work
Vice lets you identify categories of impulse spending, log or intercept a purchase you chose to skip, and redirect an equivalent amount into a savings or investment destination you connect. You control every amount and every transfer instruction.
Detection of qualifying spending relies on data from your linked institutions and may be delayed, incomplete, or incorrect. Merchant categorization is inherently imprecise. You are responsible for reviewing transfers and balances and for maintaining sufficient funds. We are not responsible for overdrafts, NSF fees, missed transfers, interest, penalties, or failed trades resulting from third-party delays, institution outages, incorrect account information, or insufficient funds.
6. Fees, subscriptions, and trials
Current pricing is shown before you purchase. Subscriptions renew automatically at the then-current price until canceled, and are billed by Apple or Google through your app store account. Cancel at least 24 hours before the end of the current period through your app store settings; deleting the app does not cancel a subscription.
Except where required by law or by app store policy, payments are non-refundable and partial periods are not prorated. We may change fees with at least 30 days' notice, and changes apply to renewals after the notice period. Your institution may charge its own fees, which we do not control.
7. Acceptable use
You agree not to:
- Use the Services for money laundering, terrorist financing, fraud, or any unlawful purpose.
- Link accounts you do not own or are not authorized to use.
- Provide false, misleading, or stolen identity or financial information.
- Reverse engineer, decompile, scrape, or attempt to derive source code except where law forbids that restriction.
- Probe, attack, overload, or circumvent security or rate limits, or access another user's data.
- Introduce malware, or interfere with the integrity or performance of the Services.
- Resell, sublicense, or commercially exploit the Services without written permission.
- Use automated systems to access the Services except through documented interfaces.
You may not use the Services if you are located in, or ordinarily resident in, a comprehensively sanctioned jurisdiction, or if you appear on a restricted-party list.
8. License and intellectual property
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial use. All software, designs, text, graphics, trademarks, and other content in the Services are owned by Vice or its licensors and protected by intellectual property laws. No rights are granted except as expressly stated.
You retain ownership of content you submit. You grant us a worldwide, royalty-free license to host, process, and display that content solely to operate and improve the Services. If you send us feedback or suggestions, you grant us an unrestricted, perpetual right to use them without obligation to you.
9. Third-party services
The Services interoperate with third parties including financial institutions, data aggregators, payment processors, app stores, and analytics providers. We do not control and are not responsible for third-party services, their availability, accuracy, or their acts and omissions. Your relationship with those parties is governed by their terms.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, that data will be accurate or complete, or that any savings, return, or financial outcome will be achieved. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, Vice and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, lost investment opportunity, market loss, loss of data, or goodwill, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility.
Our total aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amounts you paid Vice in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Nothing here limits liability that cannot be limited by law, including for fraud or personal injury caused by our negligence.
12. Indemnification
You agree to indemnify, defend, and hold harmless Vice and its affiliates and personnel from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your content, your violation of these Terms or applicable law, or your infringement of any third-party right.
13. Arbitration and class-action waiver
Please read carefully — this affects your rights. Except for small-claims matters and requests for injunctive relief regarding intellectual property, you and Vice agree that any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in the county where you reside or by videoconference.
You and Vice waive any right to a jury trial and to participate in a class, collective, or representative action. The arbitrator may not consolidate claims without both parties' consent. If this waiver is found unenforceable as to a claim, that claim proceeds in court and the rest remains in arbitration.
Opt-out: you may reject this arbitration agreement by emailing legal@usevice.com within 30 days of first accepting these Terms, including your name and the email on your account. Opting out does not affect any other part of these Terms.
Before filing, the parties agree to attempt informal resolution for 30 days after written notice of the dispute.
14. Governing law and venue
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, and, where applicable, the Federal Arbitration Act. For matters not subject to arbitration, the state and federal courts located in Delaware have exclusive jurisdiction, and you consent to that venue. Mandatory consumer-protection rights in your country of residence remain unaffected.
15. App store terms
If you obtain the app from Apple: these Terms are between you and Vice, not Apple; Apple has no obligation to provide support or maintenance; Apple is not responsible for any product warranty, claim, or third-party intellectual property claim; and Apple and its subsidiaries are third-party beneficiaries entitled to enforce these Terms against you. You represent that you are not located in an embargoed country or on a prohibited-party list. Equivalent terms apply to Google Play and its Developer Distribution Agreement.
16. Suspension and termination
You may stop using the Services and close your account at any time. We may suspend or terminate access immediately for violation of these Terms, suspected fraud or illegal activity, risk to other users, or as required by law, and may discontinue any feature with reasonable notice. On termination, your license ends; sections that by their nature should survive — including payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution — survive. Pending authorized transfers may still settle, and funds held at partner institutions remain subject to those institutions' terms.
17. Changes to these Terms
We may modify these Terms. For material changes we will provide notice by email or in-app at least 14 days before they take effect, unless a shorter period is required for legal or security reasons. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services and close your account.
18. General
These Terms and the Privacy Policy are the entire agreement between you and Vice about the Services. If a provision is held unenforceable, it is limited or severed and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset sale. Notices to you may be sent to the email on file; notices to us go to legal@usevice.com. We are not liable for delays or failures caused by events beyond our reasonable control.
